This Privacy Policy explains how Ezytix collects, uses, discloses, transfers, stores and protects personal data when you use www.ezytix.com, the Ezytix mobile applications and our related services (collectively, the “Services”). It also explains your rights and choices. Please read it together with our Terms of Service and Cookie Statement. Capitalized terms not defined here have the meanings given in our Terms of Service.

If you are in India, this Policy is designed to comply with the Digital Personal Data Protection Act, 2023 (the “DPDP Act”) and the rules made under it; Section 16 sets out your rights as a Data Principal and how to contact our Grievance Officer / Data Protection Officer. If you are in the EEA, Switzerland or the UK, Section 17 sets out your rights under the GDPR / UK GDPR. If you are a resident of certain U.S. states, Section 18 sets out additional rights.


1. Who We Are

The Ezytix Services. We are a ticketing and event-management platform.

Ezytix is a ticketing and registration platform that helps people create, discover, promote and register for events. Our products, features and offerings are available (a) online through www.ezytix.com and related websites (the “Site(s)”); (b) off-platform, including entry management, sponsorship, promotion and distribution services; and (c) through our mobile applications, web pages, application programming interfaces and sub-domains (the “Applications”). Items (a), (b) and (c) are collectively the “Ezytix Properties” or the “Services.”

Who is responsible for your personal data. The Ezytix entity responsible for your data depends on where you are located.

In this Policy, “Organizer” means an event creator using the Services; “Consumer” means a person who uses the Services to discover, register for, purchase tickets to, or attend an event; and “User,” “you” and “your” mean any Organizer, Consumer or other person who uses the Services.


(a) If you are located in India, the entity responsible for your personal data (the data fiduciary under the DPDP Act) is Shankus Entertainment Private Limited, having its registered office at Keshav Holiday Resort, Ahmedabad–Mehsana Highway, Ambasan, Amipura, Mehsana, Gujarat – 384435, India (“Ezytix India”).


(b) If you are located in any other jurisdiction, the entity responsible for your personal data (the controller) is Shankus Entertainment LLC (doing business as EZYTIX), a Tennessee limited liability company (Secretary of State Control No. 000977294), having its principal office at 212 S Horton Pkwy, Chapel Hill, Tennessee 37034-3102, U.S.A. (“Ezytix US”).


References to “Ezytix,” “we,” “us” or “our” mean whichever of Ezytix India or Ezytix US is responsible for your personal data. You can contact us at any time at privacy@ezytix.com, or at the addresses in Section 15.


2. Scope of This Policy

Application. What this Policy covers.


This Policy applies to “Personal Data,” meaning any information that relates to, or can be used to identify, an individual, that we collect from or about Users through the Services, and to personal data of our sales customers and prospects. “Non-Personal Data” is information that does not relate to, and cannot be used to identify, an individual. Where we combine Non-Personal Data with your Personal Data, we treat the combined data as Personal Data while it remains associated with you.


3. Personal Data We Collect

We collect data you give us, data we collect automatically, and data from other sources.

From all Users.


Information you give us: we collect Personal Data you provide voluntarily, such as when you register for an account, contact us, respond to a survey, register for or purchase tickets, or use parts of the Services. This may include your name, postal address, email address, phone number, the content you signal interest in (by viewing, clicking, following or searching), and any other information you choose to provide.


Information we collect automatically: we automatically collect technical data sent by the device, browser or app you use to access the Services (“Automatic Data”), which may include a unique device or browser identifier (such as your IP address), device and browser characteristics, activity and usage statistics, referral information, and data collected through cookies, pixels, local storage and similar technologies. Our Cookie Statement explains these technologies.


Inferences: we may derive or infer additional data about you (such as likely interests or event preferences) based on your use of the Services and other available information, to improve and personalize the Services.


From Organizers. If you are an Organizer, we may additionally collect payment and financial information (such as bank-account or settlement details and an address for remittances), tax information (such as PAN/GSTIN in India or a taxpayer identification number in the U.S.) required to facilitate payouts and comply with law, and a phone number that we may verify by SMS to prevent fraud. We may also receive information about you from third-party sources such as our payment-processing partners, your bank and verification or credit-reporting agencies.


From Consumers. If you are a Consumer, we may additionally collect payment information when you buy a paid ticket (such as card details and billing address). Organizers can configure registration pages to collect information from you in connection with their events; Ezytix does not control what an Organizer collects on its registration forms. When you register for or provide information in connection with an Organizer's event whether that information is yours or a third party's (for example, a ticket transferee) the Organizer will receive and may use that information, subject to the Organizer's own privacy policy (see Section 5.5). We may also receive information about you from Organizers, other Consumers, social-media integrations and our payment partners.


From sales customers and prospects. If you engage with our sales team, we may collect your name, business email, address, phone number and other professional contact details, and where you consent audio or video recordings of meetings.


4. How We Use Your Personal Data

We use your data to run the Services, communicate with you, and improve and secure our platform.


To provide the Services. We use your Personal Data to give you access to and operate the Services, process registrations and payments, deliver tickets, manage your account, provide customer support, and analyze how you use the Services.


For the purpose you provided it. Where you provide Personal Data for a specific purpose (for example, emailing us a question), we use it for that purpose.


For internal business purposes. We use Personal Data to improve the content, functionality and security of the Services, better understand our Users, prevent, detect and address fraud and wrongdoing, enforce our Terms of Service, and manage our business.


For marketing. Subject to your preferences and to applicable law, we may use your Personal Data to tell you about services or events we think may interest you, to develop and display Ezytix or event-related content and advertising on or off the Services, and to do so on behalf of Organizers based on your prior interactions. Where required by law (including in India for most promotional messaging), we will only send marketing communications with your consent, and you can opt out at any time (see Section 10). In connection with our website and email marketing campaigns, we may also share limited contact data (such as a hashed email) with advertising or social-media platforms to show you, or people with similar attributes, relevant advertisements. This practice relates to our website and email marketing only; it does not involve data collected within the Ezytix mobile application, which is addressed separately below under “Mobile app tracking and App Tracking Transparency.”


For Organizer communications. We allow Organizers to use our email and messaging tools to contact Consumers of their current and past events, so you may receive communications that originate from an Organizer and that we deliver on the Organizer's behalf. The Organizer, not Ezytix, is responsible for these communications.


For interest-based recommendations. We may make inferences about the events and activities you may be interested in, based on your profile, events attended and use of the Services, and use these to personalize recommendations and advertising, on an individual or aggregated basis, including on behalf of Organizers.


For aggregated analysis. We conduct research and analytics on an aggregated basis that does not identify you; once data is aggregated, we treat it as Non-Personal Data.


For other disclosed purposes. If we intend to use your Personal Data in a way not described in this Policy, we will inform you or obtain your consent as required by applicable law before doing so.


5. How We Disclose and Transfer Your Personal Data

We do not sell your Personal Data. We share data only as described here.


We do not sell your Personal Data to third parties. We may disclose, transfer or share your Personal Data in the circumstances set out in this Section. (Note that some U.S. state laws define “sale” or “sharing” broadly to include certain uses of third-party cookies for advertising or analytics; see Section 18.)


Business transfers. If we are involved in a merger, acquisition, financing, reorganization, sale of assets or similar transaction, Personal Data may be disclosed or transferred as part of that transaction or related due diligence, and any successor may continue to use it in accordance with this Policy.


Affiliates. We may share your Personal Data among Shankus Entertainment LLC, Shankus Entertainment Private Limited and our other parent companies, subsidiaries and affiliates, for purposes consistent with this Policy, and they are bound to protect it accordingly.


Service providers. We share Personal Data with contractors and service providers who process it on our behalf to perform functions such as hosting, payment processing, marketing, analytics, data enrichment, backup, email delivery, customer and technical support. They are permitted to use the data only to provide services to us.


Organizers. When you register for, purchase a ticket to, donate to, transfer a ticket for, or otherwise provide information in connection with an event, the Organizer of that event (and third parties involved in promoting or hosting it) will receive the information you provide, including your Personal Data (and, on a transfer, the transferee's data). The Organizer may then use that information and communicate with you subject to the Organizer's own, separate privacy policy. We are not responsible for an Organizer's (or its appointed third parties') handling of your Personal Data, and we encourage you to review the Organizer's privacy policy before providing information in connection with an event.


Social media and third-party integrations. If you connect your Ezytix account to a third-party service (such as a social-media account), or interact with our pages or social plug-ins, we and/or that third party may collect and use information in accordance with this Policy and the third party's own policies. Where you choose to integrate with, or access the Services through, a third-party service, we may disclose your Personal Data as needed to fulfil your request.


Legal requirements. We may disclose your Personal Data where we believe in good faith it is necessary to comply with a legal obligation, respond to lawful requests from public authorities, courts or law-enforcement, protect or defend our or others' rights, property or safety, prevent or investigate wrongdoing in connection with the Services, or protect against legal liability.


6. How We Store and Secure Your Personal Data

We take reasonable steps to protect your data, but no system is perfectly secure.


We store Personal Data ourselves or with third parties to whom we have transferred it in accordance with this Policy, and we implement reasonable technical and organizational security safeguards designed to protect it against loss, misuse and unauthorized access, disclosure, alteration or destruction. However, no method of transmission or storage is completely secure, so we cannot guarantee absolute security; please take care in deciding what information you send to us.


7. How You Can Access, Correct or Delete Your Personal Data

You can access, correct and delete your data.


You can access, download, correct or delete your Personal Data by using the privacy controls in your account settings or by contacting us at privacy@ezytix.com, and we will respond in accordance with applicable law. If a Consumer requests deletion, we may delete or anonymize that Consumer's Personal Data from the Services, but Personal Data already transmitted to an Organizer may remain in the Organizer's own records; you may need to contact the Organizer directly to have it removed.


8. How Long We Retain Your Personal Data

We keep your data only as long as needed.


We retain your Personal Data for as long as your account is active or as needed to provide the Services, and for a further period as permitted or required by applicable law (for example, for tax, accounting, dispute-resolution or fraud-prevention purposes). Even after deletion, data may persist on backups or archives for a limited period. For sales customers and prospects, we retain data for the duration of our relationship and a limited period thereafter.

We use cookies, pixels, local storage and similar technologies to operate, secure, analyze and personalize the Services and advertising. Our Cookie Statement explains what we use and how you can manage your preferences, and you can update your choices at any time via the “Cookie Preferences” link on our Site.


10. Your Choices

You control how much data you share and how we contact you.


Limit what you provide. You can browse the Services with limited Personal Data, though some features (such as buying a ticket, which requires your name and email) will not be available without it.


Opt out of marketing. You can opt out of our marketing emails by using the “Unsubscribe” link in any such email or by updating your email preferences in your account. Organizer-initiated communications carry their own “Unsubscribe” link that opts you out of that Organizer's messages. Transactional messages (such as your ticket, payout notices or replies to your support requests) are not marketing and will continue unless you stop using the Services. Please allow up to forty-eight (48) hours to process an opt-out. After you opt out, Organizers who already received your data may still contact you under their own policies, but not through our system.


Do Not Track. We do not currently respond to browser “Do Not Track” signals.


Targeted advertising / Do Not Sell or Share. Where offered in your jurisdiction, you can opt out of targeted advertising and of any “sale” or “sharing” of your Personal Data (as those terms are defined under applicable U.S. state law) via the “Do Not Sell or Share My Personal Information” link in the footer of our Site, or by contacting privacy@ezytix.com.


Mobile app tracking and App Tracking Transparency.


Our mobile applications do not use Apple's Identifier for Advertising (IDFA), Android's advertising ID, or any similar device identifier to track you across other companies' apps or websites for advertising purposes, and we do not share data collected within the mobile app with data brokers. Usage, product-interaction, crash and diagnostic data collected within the mobile app is used solely to operate, secure and improve the app itself; it is not linked with third-party data for targeted advertising. If this changes in the future, our iOS application will request your permission through Apple's App Tracking Transparency framework, and our Android application will request equivalent permission where required, before any such tracking begins.


11. Exclusions

Data you provide to others. This Policy doesn't cover data you give directly to other Users.


This Policy does not apply to Personal Data you provide directly to another User (including an Organizer) or that you post in public areas of the Services.


Third-party links. The Services may link to websites we do not operate or control (“Third-Party Sites”). This Policy does not apply to Third-Party Sites, and a link does not imply our endorsement; please review their privacy policies directly.


12. Children

Our Services are not directed to children, and the rules differ by country.


The Services are intended for users who are of the age of majority in their place of residence. For Users in India: under the DPDP Act, 2023, a “child” is any individual under 18 years of age. We do not knowingly process the personal data of a child in India without the verifiable consent of a parent or lawful guardian, and we do not undertake tracking, behavioural monitoring or targeted advertising directed at children. For Users in the United States: consistent with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal data from children under 13 years of age.


If you believe that a child has provided us Personal Data without the required consent, please contact us at privacy@ezytix.com and we will take steps to delete it in accordance with applicable law.


13. International Data Transfers

Your data may be transferred across borders, with appropriate safeguards.


Ezytix operates across India, the United States and other countries. Depending on your location and how you use the Services, your Personal Data may be transferred to, stored in, or accessed from countries other than your own, including the United States and India, whose data-protection laws may differ from those of your country of residence. Where we transfer Personal Data internationally, we take steps required by applicable law to ensure appropriate safeguards are in place (see Section 17 for transfers from the EEA, Switzerland and the UK). Our handling of your Personal Data remains governed by this Policy.


14. Changes to This Privacy Policy

We may update this Policy and will note the date of changes.


We may update this Policy from time to time. Changes will be posted here with a revised “Last updated” date, and where a change is material we may provide additional notice (such as by email or in-Service notice). Material changes take effect thirty (30) days after the “Last updated” date unless otherwise stated. Your continued use of the Services after a change takes effect constitutes acceptance of the updated Policy.

If you are in India and are not satisfied with our response, you may have the right to lodge a complaint with the Data Protection Board of India. If you are in the EEA, Switzerland or the UK, you may lodge a complaint with your local supervisory authority (see Section 17).


16. Additional Information for Users in India (DPDP Act, 2023)

Your rights as a Data Principal, and how we process your data lawfully.


Lawful basis and consent. Where required by the DPDP Act, we process your Personal Data on the basis of your consent, which you may withdraw at any time (withdrawal does not affect processing already carried out). We may also process your Personal Data for certain legitimate uses permitted under the DPDP Act, such as where you have voluntarily provided it for a specified purpose, or to comply with law. Before or at the time of seeking consent, we provide a notice describing the Personal Data collected and the purpose of processing; you may access this notice in English or in any language specified in the Eighth Schedule to the Constitution of India.


Your rights as a Data Principal. Subject to the DPDP Act, you have the right to:


obtain a summary of the Personal Data we process about you and our processing activities;

request correction, completion, updating or erasure of your Personal Data;

readily register a grievance with us (see Section 15) and have it addressed; and

nominate another individual to exercise your rights in the event of your death or incapacity.

You may exercise these rights by contacting our Grievance Officer / Data Protection Officer at grievance@ezytix.com. You are responsible for providing accurate information and, where you share another person's data, for having the authority to do so.


Children. We process the data of children (individuals under 18) only with verifiable parental/guardian consent, and we do not carry out tracking, behavioural monitoring or targeted advertising directed at children, as described in Section 12.


17. Additional Information for Users in the EEA, Switzerland and the UK

Your rights under the GDPR / UK GDPR.


Legal grounds for processing. We process your Personal Data where: you have given consent; processing is necessary to perform our contract with you; processing is necessary to comply with a legal obligation; and/or processing is in our legitimate interests as an event and ticketing platform (such as securing our systems, preventing fraud and providing customer service), balanced against your rights.


International transfers. Where we transfer Personal Data outside the EEA, Switzerland or the UK, we implement appropriate safeguards required by law, including the European Commission's Standard Contractual Clauses (Commission Implementing Decision (EU) 2021/914) and, for UK transfers, the UK International Data Transfer Addendum.


Your rights. You have the right to access, rectify, erase, restrict or object to the processing of your Personal Data, to data portability, to withdraw consent, and to unsubscribe from marketing. You may exercise these rights via your account settings or by contacting us under Section 15. We assess requests case-by-case and may decline where an exemption applies. You also have the right to lodge a complaint with your local data-protection supervisory authority.


Controller and processor. Ezytix may act as a data controller (for example, for the account data of Organizers, and for platform-level analytics) or as a data processor (for example, when we process a Consumer's registration data on behalf of an Organizer). Where Ezytix acts as a processor for an Organizer, the Organizer is the controller, and questions about that data should be directed to the Organizer.


18. Additional Information for Residents of Certain U.S. States

Extra rights for residents of certain U.S. states.


If you are a resident of a U.S. state with a comprehensive privacy law (including California, Virginia, Colorado, Connecticut, Utah and others), you may have additional rights, which may include the right to: know or access the categories and specific pieces of Personal Data we collect; delete or correct your Personal Data; opt out of the “sale” or “sharing” of your Personal Data and of targeted advertising; and not be discriminated against for exercising your rights. To exercise these rights, use the “Do Not Sell or Share My Personal Information” link in our Site footer or contact privacy@ezytix.com. We will verify and respond to requests as required by the applicable state law, and you may use an authorized agent where permitted.


19. Notice for People Who Do Not Use the Ezytix Services

How we may hold data about non-users.


Even if you do not use the Services directly, we may collect and process limited Personal Data about you for example, where an Organizer or another User provides your information to us (such as when a ticket is transferred to you, or your details are included in an Organizer's guest list or contact upload), or where you interact with our advertising. In these cases, we process that data in accordance with this Policy and applicable law, and the rights and choices described above (including how to contact us in Section 15) apply to you.
